Agreement To These Terms

These Terms of Service govern use of the Desired Dynamics LLC website and purchases from Desired Dynamics LLC. By visiting the website, submitting information, approving a proof, booking a service, or placing an order, you confirm that you are legally able to enter into this agreement and agree to these terms and the policies incorporated into them.

Products, Pricing, and Availability

We try to display product descriptions, photographs, colors, dimensions, prices, and availability accurately. Screen settings and natural material variations may affect appearance. We may correct errors, update information, limit quantities, discontinue products, reject or cancel an order, or refund an unavailable item. Prices and promotions may change before an order is accepted and do not apply retroactively unless stated otherwise.

Orders and Payment

An order is not accepted until payment is authorized and we confirm acceptance. Customers must provide current, complete, and accurate billing, shipping, and contact information. Applicable taxes, shipping charges, rush fees, design fees, and other disclosed charges will be shown before purchase or stated in a written quote or invoice.

Customization and Customer Content

Customers are responsible for the accuracy and legality of all names, dates, wording, logos, photographs, artwork, files, and instructions they submit. By submitting content, the customer represents that they own it or have permission to use it and authorizes Desired Dynamics LLC to reproduce, resize, adapt, and engrave it solely to fulfill the order. We may refuse content that is unlawful, infringing, hateful, threatening, obscene, deceptive, or otherwise inappropriate.

Proofs and Revisions

A proof is a visual guide and may not reproduce the exact color, grain, scale, or engraving depth of the finished material. The customer must approve all details before production. Unless a listing or quote states otherwise, additional revisions, redesigns, rush work, or changes requested after approval may require an additional fee and may extend the completion date.

Care and Intended Use

Customers must follow all product-specific care and safety instructions. Wood and leather products may change with moisture, heat, sunlight, cleaning products, or ordinary use. Unless a product is expressly described as food-contact safe for a specific use, do not assume that every decorative or engraved surface is suitable for direct food preparation. Desired Dynamics LLC is not responsible for damage caused by misuse, improper care, unauthorized alteration, or use contrary to instructions.

Events and Service Bookings

Live engraving, event, wholesale, corporate, and other service bookings may be governed by a separate quote, invoice, or agreement covering deposits, guest counts, venue access, setup requirements, travel, rescheduling, cancellation, and overtime. If those written terms conflict with these general Terms of Service, the service-specific terms control.

Intellectual Property

The website and its original text, graphics, photographs, logos, product designs, layouts, and other content are owned by or licensed to Desired Dynamics LLC and are protected by applicable intellectual-property laws. No content may be copied, reproduced, sold, distributed, or used commercially without prior written permission. Purchasing a product does not transfer ownership of the underlying design or digital artwork unless a written agreement expressly says otherwise.

Prohibited Use

You may not misuse the website, interfere with its security or operation, introduce malicious code, scrape or copy content at scale, impersonate another person, submit fraudulent payment information, infringe another person’s rights, or use the website or products for unlawful purposes.

Third-Party Services and Links

The website may use or link to third-party platforms for payments, shipping, social media, or other functions. Desired Dynamics LLC does not control third-party sites, services, availability, terms, or privacy practices. Use of a third-party service is subject to that provider’s terms.

Disclaimer and limitation of liability

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis without warranties not expressly stated in writing. Desired Dynamics LLC does not guarantee uninterrupted or error-free website access. To the fullest extent permitted by law, Desired Dynamics LLC will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from website use, a product, or a service. For a claim relating to a paid order, total liability will not exceed the amount paid for the product or service giving rise to the claim. Nothing in these terms excludes a warranty, remedy, or liability that cannot lawfully be excluded or limited.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Desired Dynamics LLC harmless from third-party claims, losses, and reasonable costs arising from content you submit, your unlawful use of the website or products, or your violation of these terms or another person’s rights.

Governing Law and Disputes

These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in a court of competent jurisdiction in New Jersey, unless applicable law gives the consumer the right to bring the matter elsewhere. Before filing a claim, please contact us and allow 30 days for a good-faith effort to resolve the issue. This section does not limit rights or remedies that cannot be waived under applicable consumer law.

Changes and Severability

We may update these terms by posting a revised version with a new effective date. Changes apply prospectively unless the law permits otherwise. If any provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of it.
